TERMS OF SERVICE

General Provisions

  1. These Terms of Service (hereinafter: “Terms”) define the rules and conditions for using the website rewiredflow.com (hereinafter: “Website”).
  2. The Terms constitute regulations within the meaning of Article 8 of the Act of July 18, 2002, on Electronic Services (hereinafter: “Electronic Services Act”).
  3. The Service Provider is Piotr Starobrat, conducting business under the name: Piotr Starobrat CodeBorn (permanent business address: ul. Azaliowa 38/1, 62-002 Złotniki), registered in the Central Register and Information on Economic Activity maintained by the minister competent for economy, having NIP: 5562568352, REGON number: 340907142 (hereinafter: “Service Provider”).

Pursuant to the provisions of Regulation (EU) 2022/2065 of the European Parliament and of the Council of October 19, 2022, on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act) (hereinafter: “DSA”), the Service Provider has designated a contact point for direct communication with EU Member States’ authorities, the European Commission, the Digital Services Board, and Website Users on matters covered by the DSA regulation.   6. Service Recipients and Users are obliged to familiarize themselves with the Terms before using the Website.

Definitions

Words written with a capital letter used in the Terms have the following meaning:

  1. Website - the website available at rewiredflow.com;
  2. Electronic Services Act - term defined in § 1 para. 2 of the Terms;
  3. Consumer - a natural person performing a legal act with the Service Provider not directly related to their business or professional activity;
  4. Entrepreneur - a natural person, legal person, or organizational unit without legal personality, which a separate act grants legal capacity, conducting business or professional activity in their own name;
  5. Privacy Policy - a document containing information about the processing of personal data of Service Recipients by the Service Provider;
  6. Service Provider - term defined in § 1 para. 3 of the Terms;
  7. Service Recipient or Client - a client using the Website, being an Entrepreneur or Consumer;
  8. Terms - term defined in § 1 para. 1 of the Terms;
  9. User - a person using the Website.

Technical Requirements

  1. For proper use of the Website, all of the following requirements must be met:
    1. a device with a monitor (screen);
    2. internet connection;
    3. equipment enabling the use of internet resources;
    4. current version of an internet browser enabling the display of hypertext documents on the device screen, connected to the internet via the World Wide Web service, supporting JavaScript programming language, and accepting cookies;
    5. active email address.
  2. It is prohibited to use viruses, bots, worms, or other computer codes, files, or programs on the Website (in particular, scripts and applications automating processes or other codes, files, or tools).
  3. The Service Provider informs that it applies cryptographic protection of electronic transmission and digital content using appropriate logical, organizational, and technical means, in particular against third-party access to data, including through SSL encryption, password protection, and antivirus or anti-malware programs.
  4. The Service Provider recommends that despite the safeguards mentioned in para. 3 above, using the internet and electronically provided services may involve the risk of malicious software entering the computer system and the Client’s device or third parties gaining access to data on this device. To minimize the mentioned risk, the Service Provider recommends using antivirus programs or internet identification protection measures.

General Rules for Using the Website

  1. The User is obliged to use the Website in a manner consistent with generally applicable law, the provisions of the Terms, and good practices.
  2. It is prohibited to share content that is inconsistent with the law.
  3. The User using the Website is obliged to provide only data (including personal data) consistent with the actual state. The Service Provider is not responsible for the consequences of the User providing false or incomplete data.
  4. All declarations, demands, notifications, and information mentioned in the Terms may be submitted via email, unless a specific provision of the Terms states otherwise.

Service Provider’s Liability

  1. The Service Provider undertakes to provide services with due diligence.
  2. To the extent permitted by the provisions of the Civil Code, the Service Provider is not liable to Users for the consequences of:
    1. Users using the Website in a manner contrary to its intended purpose;
    2. Users providing incorrect or false data.
  3. To the extent permitted by the provisions of the Civil Code, the Service Provider is not liable for disruptions in the Website’s operation resulting from:
    1. force majeure;
    2. necessary maintenance and modernization works carried out on the Website;
    3. causes on the User’s side;
    4. causes independent of the Service Provider, in particular actions of third parties for which the Service Provider is not responsible.
  4. The Service Provider undertakes to carry out the works mentioned in para. 3 point 2 above in a manner least burdensome for Users and, if possible, to inform them in advance about planned works.
  5. The Service Provider undertakes, to the extent possible, to remove disruptions in the Website’s operation on an ongoing basis.

Service Provider’s Intellectual Property

  1. All elements of the Website, in particular:
    1. Website name;
    2. Website logo;
    3. photos and descriptions;
    4. Website operation principles, all its graphic elements, interface, software, source code, and databases;
    5. data integration methods and synchronization algorithms
    • are subject to legal protection under the provisions of the Act of February 4, 1994, on Copyright and Related Rights, the Act of June 30, 2000 - Industrial Property Law, the Act of April 16, 1993, on Combating Unfair Competition, and other generally applicable law provisions, including European Union law provisions.
  2. Any use of the Service Provider’s intellectual property without their prior, express consent is prohibited.

Personal Data Processing

  1. Information about the processing of personal data by the Service Provider is available in the Privacy Policy at: https://rewiredflow.com/en/privacy-policy.

Changes to the Terms

  1. The Service Provider may make changes to the Terms in the case of:
    1. changes in the scope of the Service Provider’s activity;
    2. technical modifications to the Website requiring adaptation of the Terms’ provisions;
    3. legal obligation to make changes, including the obligation to adapt the Terms to the current legal state.
  2. Users will be informed about changes to the Terms by publishing its changed version on the Website. Additionally, the changed version of the Terms will be sent to Users via email.

Final Provisions

  1. The effective version of the Terms comes into force on June 1, 2024.
  2. The Terms are subject to Polish law. Any disputes arising from these Terms will be resolved through amicable negotiations, and in the absence of agreement - before the common court competent for the Service Provider’s registered office.
  3. In matters not regulated in the Terms, the provisions of generally applicable Polish law shall apply.
